PLANT RESCUE CLINIC
TERMS & CONDITIONS

1. INTRODUCTION

Welcome to the Plant Rescue Clinic. These Terms & Conditions constitute a legally binding agreement between you (the “Client”) and Earth Mason Innovations (“Company,” “we,” or “us”). By purchasing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with these terms, please refrain from using our services.


2. SERVICES PROVIDED

2.1. The Plant Rescue Clinic provides professional plant care consultation services. Services include:
    a) Written assessments of plant health conditions.
    b) Suggested plant care solutions and recommendations.
    c) Additional reference materials where applicable.
2.2. This service does not include physical plant treatment, on-site visits, or any guarantees of plant recovery.


3. FEES, PAYMENT, AND REFUNDS

3.1. Payment Processing: All payments for services must be made in full at the time of booking. Payments are securely processed through Stripe.
3.2. Pricing: All pricing is clearly stated at checkout and is subject to change at the Company’s discretion.
3.3. Refund Policy: Refunds are not available once a consultation response has been delivered. If a response has not been provided within the stated timeframe, the Client may request a refund.
    a) For the 1-2 Plants Rescue Service, if a response is not delivered within 72 hours, the Client is eligible for a refund upon request.
    b) For the 3-5 Plants Rescue Service, if a response is not delivered within 7 days, the Client is eligible for a refund upon request.


4. CONSULTATION PROCESS

4.1. Submission Requirements: Clients must complete an intake form with all required information regarding their plant’s condition.
4.2. Response Time: Standard response time is within 72 hours of receiving full payment and a completed intake form. If additional information is required, the response time will reset upon receipt of complete details.
4.3. Client Obligations: Clients agree to provide truthful, accurate, and complete information regarding their plant’s health and environment.


5. NO GUARANTEE OR LIABILITY

5.1. No Warranty: While the Company provides professional advice, results are not guaranteed due to variable environmental conditions and Client execution.
5.2. Limitation of Liability: The Company is not liable for any plant loss, property damage, or negative consequences resulting from implementing our recommendations. The Client assumes full responsibility for applying advice provided.


6. INTELLECTUAL PROPERTY RIGHTS

6.1. Ownership: All written materials, recommendations, and resources provided by the Company remain the intellectual property of Earth Mason Innovations.
6.2. Restrictions: Clients may use provided information for personal use only and may not reproduce, distribute, or resell any materials without explicit written permission.


7. PRIVACY POLICY

7.1. Confidentiality: Any personal information shared by Clients, including photos and plant details, will be used solely for service purposes.
7.2. No Data Sharing: The Company does not sell, distribute, or share Client information with third parties.


8. DISPUTE RESOLUTION

8.1. Contact & Resolution: Clients must submit any disputes or concerns via email to [email protected] within fourteen (14) days of receiving their consultation.
8.2. Governing Law: These Terms & Conditions shall be governed by and interpreted in accordance with the laws of British Columbia, Canada.


9. MODIFICATIONS TO TERMS

9.1. Right to Modify: The Company reserves the right to amend these Terms & Conditions at any time. Clients will be notified of material changes via email or announcements on our website.
9.2. Continued Use: Continued use of the Plant Rescue Clinic services after updates constitute acceptance of the revised terms.
